Notices to Enertia Power should be sent to Enertia Power, Attn: Legal Department, Buttonwood, Rosemead, CA 91770, with a copy by email to info@enertiapower.com using the subject "Notice of Dispute." We will send notices to you using the contact information we have for you. The receiving party will acknowledge the notice and make a good faith effort to resolve the matter before any proceeding begins.
Either party may request an individualized telephone or video settlement conference. The parties agree to schedule and attend any such conference in good faith, with counsel if represented, and the informal period may be extended as needed to complete that conference.
Any Dispute not resolved informally must be brought on an individual basis and may be resolved by final, binding, confidential arbitration, unless applicable law requires otherwise. The arbitrator's award may be entered as a judgment in a court of competent jurisdiction. To the fullest extent permitted by law, arbitration may not be joined with disputes involving other persons or entities.
You may opt out of the arbitration provision by sending written notice by certified mail to Enertia Power, Attn: Legal Department, Buttonwood, Rosemead, CA 91770 within 30 days after your first use of the services after these Terms become effective. If you opt out, Enertia Power will also not be bound to arbitrate with you. Enertia Power may terminate the arbitration program at any time, but termination will not affect existing disputes.
To the maximum extent permitted by law, no Dispute may be joined with another person's dispute, and no class, collective, consolidated, private attorney general, or representative proceeding may be brought. Relief may be awarded only on an individual basis and only as needed to resolve the individual claim. Any cause of action related to the website or services must be started within one year after it accrues, unless applicable law requires a longer period.
These Terms are governed by applicable law without regard to conflict-of-law rules. Where a dispute is not subject to arbitration, the parties agree to bring proceedings in a court with proper jurisdiction. If part of this dispute-resolution section is found unlawful or unenforceable, that part will be severed and the remainder will continue to apply. Past, present, and future affiliates, agents, and representatives of Enertia Power may enforce this section as third-party beneficiaries if they become involved in a dispute with you.
